Student-Athlete Employment

Criteria Governing Employment
Per NCAA Bylaw 12.4.1, all compensation received by a student-athlete must be consistent with the limitations on financial aid set forth in Bylaw 15. Compensation may be paid to a student-athlete:

1. Only for work actually performed;
2. At a rate commensurate with the going rate in that locality for similar services; and
3. An employer shall not use the athletics reputation of a student-athlete employee to promote the sale of the employer’s product or services

Athletics Reputation
It is impermissible for a student-athlete to receive compensation or extra benefits for value or utility that he/she may have for an employer because of publicity, reputation, fame or personal following that he/she has obtained because of athletics ability.

Modeling/Musician/Performer
Per NCAA Bylaw 12.5.1.2, an individual may accept remuneration for or permit the use of his or her name or picture to advertise or promote sale or use of a commercial product or service without jeopardizing his or her eligibility to participate in intercollegiate athletics only if all of the following conditions apply: (Revised: 1/14/97, 4/29/97, 1/8/07 effective 1/8/07)

1. The individual became involved in such activities for reasons independent of athletics ability;
2. No reference is made in these activities to the individual’s name or involvement in intercollegiate athletics;
3. The individual’s remuneration under such circumstances is at a rate commensurate with the individual’s skills and experience as a model or performer and is not based in any way on the individual’s athletics ability or reputation.
